In this Statement, the term “you” or ”your” refers to the User of Gigly Platform who uses our service to place orders, purchase or sell their services, or just use Gigly Platform, and, the term “Partner” stands specifically for User that provides services and completes orders.

1. Who We Are 

Gigly (“we”, “us”, “our”) is a mobile application that provides users with digital service and collects and processes your data unless stated otherwise.

The types of personal data we collect include, but are not limited to:

Contact Information: This includes details such as your name, phone number, and email address and other forms of contact information. For certain services, we may require additional information, such as your home or business address.

Profile Details: This includes, but is not limited to, registration data like your profile picture, saved addresses, and your language and communication preferences. Depending on the service, we may also need extra information, such as a copy of your certification for specific types of work or identity verification, which authorized third parties will manage.

Communication Records: This involves any records of interactions you have with other users through our in-app chat, or when you communicate with our customer support team.

Device Identification Data: This includes limited data about the device on which the Gigly app is installed, such as the IP address.

Location Data: This refers to information about where you need the service to be provided, the location of nearby service providers, the timing, and the progress of service delivery. In certain cases also live device location data can be used, if the permission has been granted in device settings.

Payment Details: This includes, but is not limited to, the amount charged, the payment method used, and details of the payment card utilized.

Service Order Information: This includes, but is not limited to, details such as the description, status of your orders, pricing, location, timing, and feedback on your conduct as evaluated by both parties involved in service delivery.

Other User-Generated Content: This could include photos of completed orders, reviews, and feedback you provide, and other user generated content.

In addition to the information listed above, we may also gather and receive your data from other sources, including:

  • In-App Chats: Information and content shared within the app’s chat feature related to orders or potential legal claims and disputes that involve local authorities.

  • Referral Programs: If you are referred by another user participating in our referral campaigns, we may receive your information from that user.

If you do not provide (or if you provide incorrectly) personal data, we may be unable to fulfill our contractual obligations to you or meet our legal requirements. This could also prevent us from managing your account effectively. For instance, we collect and process the personal information you provide when installing and using the Gigly app; if you decline to share your geolocation data, we will not be able to direct a service provider (Partner) to your location or show you nearby services. Similarly, if you refuse to complete an identity verification check necessary to protect the integrity of your account, your account may be suspended or blocked to prevent fraudulent activity.

3. How We Use Your Data 

We use your personal data in order to provide you with one or more of our services, including, but not limited to:

  • To Keep You Informed: We use your user account details, including your name, phone number, and email address, to communicate with you regarding essential updates and news. This includes, but is not limited to, marketing emails, notifications such as your service provider’s arrival, order completion, confirmations, unexpected issues with your order or payment, and important service-related updates.

  • To Enhance Service Quality: We collect data on order delivery statuses, delivery times, and Partner ratings based on user feedback. This data helps ensure user safety, promote compliance with our terms and conditions, and maintain a high standard of service. We also gather customer support data and correspondence for feedback purposes, as well as to provide data to responsible parties when handling disputes with local authorities and service quality issues.

  • To Optimize Order Delivery: We use geolocation data to ensure orders are delivered accurately and without interruptions. This helps us resolve any quality issues related to our services and ensures smooth deliveries to the correct address.

  • To Ensure Fair Pricing: We collect information on price offers, requests, listings, and bids. This data is aggregated and analyzed to help users engage in fair pricing practices.

  • To Process Payments: We collect payment details to process transactions securely when confirming and completing orders. Payments are handled through trusted third-party providers such as Stripe and MobilePay to ensure secure and efficient payment management.

  • To Assist in Placing Orders: We collect data regarding your location and the services available in your area to improve order placement. By analyzing the geographical coverage, seasonality, and order categories, we aim to enhance the clarity and categorization of orders and offers.

  • To Optimize App Performance: We use your contact details to notify you about updates and improvements to the Gigly Platform, making it easier and more convenient to use. We also collect limited data from your device, mobile network, and other services to authenticate and verify your account for security purposes.

  • For Seamless Deliveries: We share your geolocation data and phone number with our partners during deliveries to ensure a smooth and transparent process. Geolocation data is only collected while the Gigly app is active and stops once the app is closed.

  • To Connect You with Partners: We collect and process personal data to match you with the nearest service-providing users (Partners). In-app chat data between users is processed for security purposes, product and service improvements, analysis, and customer support, including, storing records for when they might be necessary for legal disputes between users and Partners, that are handled and requested by local authorities.

  • To Personalize Your Experience: We use your usage data to tailor content, recommendations, and features that align with your preferences, providing you with a more personalized experience.

  • To Improve User Matching: We utilize location data to enhance the compatibility of service requests with available Partners, ensuring efficient and relevant connections between users and providers.

  • To Analyze and Improve Our Services: We anonymize user data for analysis purposes to enhance our services, understand trends, and improve overall user satisfaction.

  • To Communicate with You: We use your personal data to send important updates, respond to inquiries, and provide customer support as needed.

  • To Ensure Data Security: We implement security measures to safeguard your data and protect against fraud.

4. Marketing and Notifications 

  • We only send marketing emails or messages with your explicit consent. We may personalize direct marketing messages using information such as your frequency of app usage and your order preferences on the Gigly Platform.

  • Notifications and in-app advertisements are integral to the Gigly service and do not require special consent. However, if you wish to opt out of these, you can disable this option in your in-app settings.

  • If you no longer wish to receive direct marketing messages, you can easily unsubscribe by clicking the “Unsubscribe” link in the footer of any marketing email or by adjusting your preferences in the Profile settings of the Gigly app. If you need assistance with withdrawing consent, you can contact us at support@gigly.fi.

5. Legal Basis for Processing

  • Service Providers: We work with third-party vendors like Stripe and MobilePay to process payments and provide other essential services. These providers are bound by data protection agreements to ensure your data remains secure.

  • Google Services Integration: We utilize Google Services to enhance our location-based services. Your data used within this integration is governed by Google’s privacy policy.

  • Legal Authorities: We may share your data if required by law, or if necessary to protect our rights or ensure the safety of others.

  • Other Users: Feedback provided about service quality is anonymous. Your ratings remain private between you and Gigly, and are not shared publicly with other users.

  • Order Delivery Data: Limited information required for order delivery, such as your contact and delivery details, may be shared with partners or other users to ensure smooth order completion. This data is typically available for 24-48 hours post-delivery to resolve any unforeseen issues.

7. International Data Transfers

Your data may be transferred to and processed in countries outside the European Economic Area (EEA). We ensure that such transfers comply with GDPR requirements by implementing adequate safeguards, such as Standard Contractual Clauses.

8. Data Retention 

We retain your personal data only as long as necessary for the purposes outlined in this policy or as required by law. We adhere to GDPR regulations for data retention, ensuring that your data is securely deleted or anonymized once it is no longer needed.
